Current INTERIM order dad and mom share joint legal and joint physical custody - dad with primary.
IF the judge decides to make the interim order permanent and dad sues mom for child support, can the income of his new spouse be considered given that she earns substatially more than both mom and dad, who earn roughly the same? Would that be considered a "special circumstance"?

The current Idaho support guidelines allow for not including the income of the spouse but using that income as available resourses to either parent in the calculations of support.

Never mind - this just became comletely irrelevant since after a whopping 2.5 months they are now getting a divorce.
