Hi all,


My dad had a stroke and is in a nursing home since last year. The house is in my brother's name to save the house from a foreclosure/leins in 98 but is really my dad's and my sister is the POA. They needed to sell the home and told my father they are doing so and I can understand that. Now, I find out my brother and sister have arranged for an estate sale to sell all my father's and deceased mother's belongings. My sister and brother refuse to tell my dad she is selling his and mom's stuff saying because it would break his heart to know. Can they do this without my dad's knowledge/permission and do I have any rights to my Mom's stuff? Also It is not clear where all this money from all these sales are going to, should this all be recorded somehow so show the monies are not being used by my siblings. Thanks all.

If sis is the POA, then that written document gives her the right to do what she is doing.

What does the written document say about her accounting for the dough?

I don't have any idea what was written on the POA document. I believe it was granted during the time my father was in ICU and needed medical care, we all thought he would pass away because most do not survive the type of stroke he had.

In the beginning we all had agreed to do everything together, since then they have not been too forward with any of the dealings with dad's stuff and I'm always told and not asked at very last minute, if told at all.

My father can't speak and has problems with his right side but I think he is of sound mind and they still can do this without him knowing? I know it all depends on what the POA document says, right?? ;) Thanks for your reply!
