My Sister-in-law lives in NY. Her (seperated) hubby lives in Maryland. They have one child together. They have a seperation agreement that states that they both have joint custody. They both agreed that the daughter could spend Christmas with the Hubby's folks in New York. When my Sister-in-law came to pick up her daughter, she found that her hubby had already got her and taken her to Maryland.
She contacted him and he told her that she wouldn't be allowed to see her daughter and that he had a restraining order against her. He said that if she came to his house, he would call the cops and they would issue the restraining order. This all sounds VERY fishy to me, as she has never threatened or abused her hubby or daughter.
He further stated that he would allow her to see her daughter IF she signed a notorized contract stating that she would "move residence either with him or within 2 hours travelling distance by 15MAY02". This makes no sense to me. Why would somebody have a restraining order against someone if they want them to move in with them?
I personally think that he is just trying to get his way and the whole restraining order business is a fabrication.
Could someone give out some good legal advice in this case? I would greatly appreciate it!
