My sister who lives in a rest home is a diabetic and has had her right foot amputated below the knee. She is wheel chair bound. A nurses aide in the resthome accidently ran over her little toe on her good foot, with another residents wheel chair. The injury caused her to lose her toe and it looks as though she might lose her foot. This has caused her a lot of pain and suffering. Even though she has medicare and a good medical insurance, should I seek compensation from the nursing home?

My response:

Diabetes is one of the strangest illnesses. In this case, it is not unusual to lose limbs, toes, etc. as a result of the disease.

The problem with this scenario is the disease is extremely progressive, and the toe and foot may have been the next to go in any event.

You'll need to hire a medical malpractice or personal injury attorney to investigate with an expert doctor's help, to determine whether it was the "incident" that caused the latest amputation, or whether it was a natural course of the disease. In either case, and because of the disease, it is highly doubtful that your sister's claim is worth very much at all. The "expert" testimony your sister will need will cost far more than her claim is possibly worth.
