What is the name of your state? NY

My sister is dying from pancreatic cancer. Her husband has a girlfriend in his home country and he's just hanging around to collect the money from the pension and life insurance. My sister has changed all documents to make me the beneficiary, but is there anything else we should do to ensure that the money will go to me and not the husband? I plan to make a trust fund for my niece with the money instead of her father spending it on his girlfriend. Any help would be great. Thank You! ;)

Make sure she has a last will and testament drawn up (with the assistance of an attorney) that specifically disinherits her husband by leaving him only a nominal amount (such as $1.00 or $100) and that names you as beneficiary of everything, and consult with the attorney to find out what rights, if any, husband would have to any part of this estate.

How is her bank account set up--with husband as joint account owner or beneficiary, or has she changed this to your name as well? Just trying to prevent him from taking the money out and spending it on new girlfriend!!

You may have done everything correctly but you need to find out in advance of the death if that is true in order to prevent/anticipate any future problems.

Your sister also needs Advanced Health Care Directives (Living Will) that nominate someone (you) as her medical power of attorney and conservator. Also have her final burial instructions in this document. Her making and paying for prearrangements should ensure that her funeral wishes are honored. She needs to be enrolled in Hospice.
