Well, just to clear the air, I'm an 18 year old college student who really needed a ride. My sister (who lives in Oregon) called me up when her boyfriend of four years got arrested, and under power of attorney, asked me to buy his 1988 Blazer to raise some money for him. I asked her what the condition of it was, and she said it ran great and passed smog (while Oregon as a state does not have smog laws, the city of Salem does).
My mom went to pick it up for me, which cost me $200 for gas, food, and the likes, and her about two days of work. The only thing is, I noticed that the Blazer (which I spent $700 on) was smoking really bad, so I took it to a mechanic. He said that the engine needed to be overhauled (which would be around $2,500-$3,000) and that there was no way it could have passed smog recently like my sister said. While driving it home, we were pulled over and got tickets for multiple traffic violations (little things, like broken tail lights and the likes, but also including gross polluting). The car, which was supposedly insured under my sister and her boyfriend, has in fact not been insured for over three months, and the proof of insurance was expired.
In order to dodge most of the bullets, I had to put $500 into repairs into the Blazer, but my mom is still facing a very huge ticket for driving without insurance (which is to be decided later this month). What's worse is that it has been four months since I bought the Blazer, and my sister has yet to send me a title. I've asked her repeatedly, but she refuses, having apparently lost the original title, and the DMV has "supposedly" never sent her a new one upon request. On top of that, she refuses to honor her word to buy back the Blazer if it didn't pass smog.
So to put it simply, I want to know what my legal rights are. Can I sue my sister in small claims court? Just how much of the money can I get back, anyway? Just the money I paid for the Blazer, or the $200 I had to spend to transport it down here to California and the $500 I had to pay to have it repaired to avoid the inherent tickets as well? And the big question, do I have to go to Oregon to sue her? Or can I file here in California, and thus have the trial take place here? Any help would be greatly appreciated. I'm really in a bind here, especially with most of my savings having gone into the Blazer, and me needing a car to get to work and to college. Thanks again.
