skateboard injury

What is the name of your state? Georgia

My son had a skateboard accident which resulted from another boy's foot hitting the front wheels of his skateboard. My son believes he did it intentionally but not maliciously. The boy says it was an accident. He says he was walking beside my son as he was skating and his foot accidently hit the front wheels. Either way, the accident resulted in my son getting a chipped tooth and a small fracture of the tooth within his gum. So far, the dentist's bill is $179.00. The dentist wants to do monthly x-rays for the next 6 months to monitor the the fracture and to make sure a root canal won't be necessary. Are the boy's parents responsible for my son's present and future dentist bills that are a result of their son's actions?
I've read a little about injuries and the law and wondered if this wouldn't fall under "proximate cause".What is the name of your state?

Since you 'read alittle about injuries and the law' you are infinately qualified to sue the boy and his parents.

Please let us know how much you win in your settlement conference and when the check is in the mail.

I was in a very similar incident when i was 15 years old with another child. I now live with a harrassment, dissorderly conduct and simple assault charge on my record and was on probation for 6 months. The parents thought I intentionally pushed a kid, when really he tripped trying to run away while we were clowning around. The kid was concussed and didn't remember we were clowning around.

Kids will be kids. He was not seriously hurt and if your insurance covers it, then, IMO, let it go.

But, I guess parents are always looking for other people to blame. Their precious child gets hurt, as kids always do, but they just can't handle it.

It is still coming up on searches when I applied to the County Sheriff's office. I am not sure why it followed over, but it did.

I also got into trouble while i was a juvenile. and was looking int law enforcement , I talked to juvenile court where i live, and they said if its minor i can have my record expunged. I have a cerfew, and disorderly conduct They told me that id have to talk to a judge to get it done, Havent done it yet tho.


kids will be kids as someone said before. If the kid did do it on purpose, he needs his parents to kick that AS S more then anything.

If you dont want your kids to get hurt. dont let them skateboard. You have to expect that they are going to get hurt. Almost everyone that i know that skates has been hurt at one point or another. sometimes its not their fault, someone will run into them at the skate park. but they dont sue. as the saying goes, "dont play with fire if you dont want to get burned"

I'm only a sophomore but my dad teaches me a lot about this. I know you wouldn't take a teenager's advice but I say sue them. Accident my ass. You'd have to be a retard to be walking alongside someone and "accidentally" sticking your foot in front of the wheels. What is the kid, a clown? Unless the kid wears canoes instead of shoes, it was on purpose.

If this is what your father teaches you, that suing every time life doesn't go your way is the only way, then I think you should look elsewhere for a teacher.

He doesn't teach me to sue all the time. It's just the way I am. Someone wants to be stupid, they're going to be bit right back in the ass. This is definitely a situation in which you should sue if your son has high medical bills.

NYCboy, this is probably a great opportunity to sit back, read and learn. Maybe it will help you decide if a career in law is where you want to go. However, as a sophmore in high school, your legal knowledge is admittedly limited. Might not be the right time to give advice. Although, I did like the comment about the kid wearing canoes instead of shoes, now that was funny.

That's why I said I know he wouldn't take a teenager's advice. But I do know more about law than the average teenager and proabably the average adult. I read about this stuff, my dad teaches me, and he shows me his work to get an idea of what he has to do and why. I'm not telling anybody to take my advice, although, for a sophomore, I'd say my adive isn't bad.

My actions are not stupid. I'm only a sophomore, so not everything I say will be correct. But what I'm trying to say is it's the kid who stuck his foot in front of the skateboard's fault.

And since you know that ahead of time, it would be prudent NOT to say what you know to be wrong.
But what I'm trying to say is it's the kid who stuck his foot in front of the skateboard's fault.
And again, you have no idea what happened because you were not there. Now, please post in return all of the facts that must be proven in court before the other child (and parents) can be found legally liable.

The kid who stuck his foot in front of the skateboard did it on purpose. I've had it done before. You'd have to be bigfoot to do that on accident. I was skateboarding, and some kid I didn't even know tried tripping me up, and he didn't. He didn't realize I had 4 other kids with me. He left after that. Little punk thought he was some tough guy.:rolleyes:
