I got an MIP last night while skateboarding around down town (it's a small college town) at around 2:30am. I had roughly three standard drinks in an hour or two before I left, I was fine for a while but then suddenly became sick and vomited into some shrubbery on the main strip. There was no one walking around, I was being quiet and benign, but a cop car driving by saw the vomit and two officers came and talked to me. They asked if I'd been drinking tonight and I told them that I'd had two store bought drinks but never specified a time-frame, they asked me to blow and I politely refused. After talking to the cops for a few minutes both of them agreed that I didn't appear intoxicated at all. So, they wrote me an MIP and told me I could probably plea bargain to get it off my record.
Now, what I'm wondering is if I can get my charge either dropped or reduced to something more fitting, like vandalism (they said the biggest thing was the cleanup of the vomit). I didn't have any containers on me, no one can prove I was drunk, I told them I drank but never specified a time, so I could have been stone sober by then for all they know.
Also, what if my parents were visiting me at my apartment while I was drinking, wouldn't that make the whole situation legal as pie? I mean, since when is it illegal to get nauseous while enjoying a ride around town late at night?
