My tennant has just come up for her lease renewal and do not want to rent to her another year. Tennant has been chronically late the entire first year lease. It has been a constant struggle to collect rent from her at all or on time. Have been very understanding by letting her stay. Lease renewal is on
Feb. 17 and rent for Feb has not been paid. Need to know how much notice I must give tennant that we will not be renewing her lease and how much time does she have to vacate. Can I still choose to not renew lease if rent is offered? Also, power has remained in my name (this was not in lease agreement-kept it this way to help her as she cannot get power in her name) this past year. By law, am I allowed to have the power turned off in my name if covering the utilities is not stated in lease agreement?

What is in the lease?

Usual lease agreements, are for the amount of time stipulated in said agreement.
I will rent to you for a year, expires this date.
Then you have the option to renew. If you do not, it usually becomes a month to month rental.
Then look up the LL/tenant law for NC for how to get rid of a month to month tenant.
As far as the power is concerned, that may be considered retaliatory, I am not sure... if she doesn't pay those bills it would hurt your name though, I would be afraid of that as well.

Was it not spelled out in Lease, that you would be paying for these utilities, or were not?

I was in a completely different state, but my lease said they would pay, electric, water and trash, (and cable was included but could have been changed whenever they wanted to change carriers) they could not have turned off anything, even if I was late... which I was not.
When you get this slow payor out, make sure your next lease is very well written according to the statutes of your county/state.

Tennant signed a lease from 2/04 to 2/05. Lease is up and tennant is still there. No money has been paid for 2/05. Do not want to renew lease with tennant.
1. Tennant will not return phone messages as of 2/15. Can I evict my tennant?
2. Can I refuse to renew lease? If yes, how much notice does tennant have to have to vacate?
3. Power is in my name, I pay the bill and tennant pays me. This was not agreed upon in the lease. This was done to tennant as favor during hard times.

Need help! Urgently want tennant out of property but not sure of legal rights.

Lease has expired

I would say lease has expired.
I would say give 3 day to pay.
Then go through the steps that your state stipulates in LL/Tenant law that
you have read...?
Now Tenant (Not tennant) is month to month..follow those guidelines,

I wouldn't do that utility thing again... and I don't know what to do about that at this point, lets hope you don't get screwed on that bill, too.
