In June 2005 my husband's new business contracted a marketing agency to perform a service. Without exception, every other marketing effort targeting 10,000 potential customers has yielded some response. There were zero responses from the campaign which caused us to be suspicious if he had actually fulfilled his responsibilities. We pressed for verification, but the contract did not specify that he had to provide a list of company names that he would distribute coupons to (live and learn to distinguish a bad contract).All we haveSince then we have contacted the Better Business Bureau and vocalized my dissatisfaction to anyone who has asked.

He stopped by our shop today threatening and attempting to intimidate us that he had grounds for suing. Should I be concerned?

Should you be concerned about a lawsuit? Well, that depends on whether or not this guy would actually sue. If you are concerned about whether or not you might lose a lawsuit or not, well, that depends on what exactly you've said about this person and his business.

We have not actively campaigned against this guy. When we became frustrated trying to reach him about a month after we had paid him, we started asking around to others in the business. The typical responses, "Oh no, I hope you didn't pay him" or "Did he get you too?" Ever since then when people have asked about our marketing efforts we have been honest in describing our experience with him.

The original contract was in June 2005. After months of trying to reach him (his voicemail says that he is in the office on Thursdays, but he never answered the phone and the machine does not accept messages). Also, his contract and his business card did not have a business address so I tracked him down based on our conversation of where he lived and got an address through the county offices so that I could file a Better Business complaint. That got his attention in December, but we haven't heard from him since then. The only reason that he stopped by over a year later was because as he was trying to sign up another repair shop (we declined his "generous offer to rerun the ad at considerable expense to him") the owner called on us as professional colleagues for advice. We told him that his money would be better spent elsewhere and that we felt the guy was hiding from customers (first behind the contract and then by leaving no way to contact him except by phone: doesn't answer on the day when he's in the office AND can't leave a message for him).

Again, should I be worried? He is not trustworthy and he threatened repeatedly that he could make a small business like ours pay dearly.
