What is the name of your state? New Mexico
Ok, a quick what do you think about this case.
An individual moves to a small community and attempts to start a business. The first client is a government entity. During tenure of about 2 months business picks up and life is good. A change of leadership in the entity occurs. After 30 days the new leadership dismisses the individual from service and then refuses to pay the outstanding bill, which is over $4000. The individual attempts to recover the payment without success and is forced to file suit. After the suit is filed, but before the case is heard, the leadership makes many defamatory remarks, slander and libel per se. Accusations of criminal actions which were false and not made to the police but to the public at large. Accusations of professional misconduct in a similar vein. Accusations of immoral acts in a similar fashion. Filing legal documents and causing stories to be published in the local print media that are false and served to destroy the individual's reputation and business in the small community.
The slander and libel continue for months leading up to the initial hearings and the individuals business is ruined and reputation destroyed. The individual now has no clients, and despite best efforts at advertising no new clients will approach. Can the leaders and employees be sued in this case along with the Gov't body? There are several news stories, copies of legal documents, witnesses to the defamation, and even video and audio recordings of such statements.
This is a start up business that has no real history of income so what kind of losses can be put forth and what proof of loss could be presented?
