From Arizona. I am guardian and conservator for my father who has been incapacitated due to a stroke. Every year I have to file a report with the courts on my accounting and my father's medical status. Everytime there is a court date, my father's brother, who ever since my father's stroke has tried to have me removed as guardian/conservator, comes into court and through his attorney tells out right lies about me. Most the time, the judge does not believe it but 2 months ago I had a hearing granted to me for something regarding the operation of my conservatorship and was alloted 15 minutes court time. However, during this 15 minutes, my uncle's lawyer was allowed to speak first painted a horrific and absolutely false picture about my actions as conservator and finally I was allowed only 2 minutes to try and clarify. I had nothing with me at this hearing to clarify or prove anything regarding these false accusations of accounting as the hearing was for an entirely different matter (appointing and additional back up guardian). The matter that the hearing was granted for was never even spoken of during these 15 minutes instead the judge ended up believing lies such as that I was refusing to use my father's SS checks to even provide food for him! Can I sue someone for slanderous accusations made in court especially when now, we are required to go thru a lengthy and costly evidentiary hearing to clear things up (but not until 8 MONTHS FROM NOW!). I can prove all the things said about me were lies if I am given a chance. This is not the first time they have lied about me in court but this is just the WORST time with the MOST lies. I would like to find a way to put a stop to this nonsense. Does anyone know if I have any recourse with a slander suit based on this story above?

as to your specific question on slander, no, statements made in court are not actionable except as perjury. And this is not perjury. It's opinion.
