I was assaulted by my ex fiance in New Orleans and did not file charges, instead, jumped the quickest flight back home on July 1, 2006. Once back in Houston, told him I no longer wanted to see him and broke up. He started text messaging and harassing me that Sunday evening. Monday, changed phone number. He continued to email - stating he was going to harm himself and then concocted a story that he was dying of cancer. He continued to call my family and friends, emailed them, etc. I have a police report filed and will file for a restraining order tomorrow 7/9/06. He has been told to back off, numerous times, even by a police officer. He continues to email me on a daily basis and also third parties. He sent sexually explicit details about me to a third party and also made a false statement that I had an STD to this person. My family and I own businesses in the local community and I am VERY upset about this statement. He concocted stories that his previous wife was dead, along with a child, found out this week they are VERY much alive. He has financial documents of mine that include my social security number, pay information, etc. and was in the process of buying a house. I have been in contact with the realtor and they stated that he never gave them the paperwork NOR a lender name and never intended on purchasing the house. There are many more details, and have numerous emails from this person in which he concocts lie after lie.

I have not responded to ANY of his emails since Wednesday, July 5, 2006, and he still continues to send emails to me and others.

He has also stated that he has nude photos of me and asked "where would you like for me to send these." I am scared to leave my house - I have two small children. I have been so upset over the statements that he has made to other people and what that may do to my reputation in my community and as a business owner. I am living in fear of what this person will do next.

I need to know what kind of recourse I can take to pursue a lawsuit against this person - for libel/slander - he claims to be an attorney but I have done some research and cannot find any info on his schooling, credentials etc. I know he indeed works for a law firm, however, he is in "corporate debt collections" and I have never seen a document or business card that references his credentials. I do believe I am dealing with a con-artist and I do not think he is going to stop until he finishes what he started - he has invested way too much time and energy to start over with someone new- or eventually hurts me or my children. Any advice would be greatly appreciated.

Now why did that make me smile ;)

Once you get the Order of Protection issued have him served.

Then, if you receive any further communications from him, turn them over to the local District Attorney for prosecution.

As to the STD claim. To whom did he say this, in what form (written or verbal) and can you prove it?

If you have sufficient proof (such as a credible witness or written statements) then you may have grounds to sue for either libel or slander per se.
