slander/libel harassment?

A deli I have been going to a few times a week (for coffee in the morning and to see many friends, etc.) for years before, and for the one year since the new owner bought it, recently "banned" me.

Breifly the facts are I made a minor "fat joke" about one of the employees (both he and the owner-good friends for 15 years- make many jokes (sexual, appearance, etc.) about me and others-also there is some political and intellectual tension between us. I told him he should be careful as an assault could bring liability to deli owner (but I did nothing to pursue it; no harm no foul).

The next week I was in there for an hour (another employee "Mary" was there, not the guy who assaulted me) with no incident. When I left the deli owner followed me to may car and said I would be "banned". He said it was because I thereatened to sue him and the fat joke, etc. He then said it was the second problem he had had with me as I had been "sexually harassing" Mary.


This is not true although many weeks before Mary evidently did say a joke I made did make her "uncomfortable", and the deli owner metioned that to me. I had apologized to her and she accepted and there had been no problem since with her. Also I have know her for almost a year and there have been many jokes between us all, including the deli owner who contributed to them. The joke was nothing one could not hear on Leno or MTV. Mary is 18, very pretty-a child model or so she says- and both mature and young in ways-she is Christian and does not believe in evolution.


This was the first time the term "sexual harassment" was ever mentioned. The owner said he had to keep stop Mary from "filing charges" against me. I greatly doubt this, and Mary has never said anything at all to me in this regard.


Ayway I expressed that I did not think he could "ban" me from a public place and would come back if I wanted to. I went home and upset about the absurd "sexual harassment" claims called the deli to talk. The owner talked for a minute but hung up, I called back he again talked for a minute and hung up.


With in an hour there was a police car at my house (later a second back-up car) and the female Officer was very one sided and judgemental. She said I was not to go back to the deli rse) and I said fine but wanted to give her my side of the story, i.e. the previous borderline assault a few days before which led to all of this, etc.

Then the officer said there were claims of "sexual harassment" and that she spoke with "Mary the eighteen year old" . She would not tell me what Mary said ("I will not do your investigation for you") and while Mary is listed the the police report as an "other" there is no comment or quote from Mary. Everything is from the deli owner but it does say I made a "lewd" comment to Mary, and continued to cause disturbances.

Remember this was a minor joke, weeks before and had been totally resolved. The deli owner has also has since told other customers that I "sexually harassed" Mary. He has also said, evidently jokingly and not, to customers and to Mary that I travel to Asia and South America for sex with young girls and boys (I do travel a lot, but certainly not for that-I am single but pretty "straight")

To sum up I feel I have been slandered (libel in the police report) and harassed by having the police needlessly sent to my home.

I want to sue (for an apology and some money damages- but those will all absolutely go to legitimate charity) but will do it as a Pro Se as I have much spare time, and some legal background. Obviously to use an attorney would be very expensive and I am doing this for principle.
