slander/libel

What is the name of your state? California

I recently was told I was going to be sued for slander for calling a gentlemen that was owed 12,000 by a woman and advised him to get his car back if she owes him 7 months of payments. I stated she has a history of lawsuits (which is the truth) and she may find a way to sue you to get out of paying you. I never made any false statements, I simply told him of the prior court cases and the two she has in september. I also warned those two people anonymously that she makes her living suing, be careful and bring it up in court.

Since that is the truth, and it is my opinion, she cannot sue me correct? I actually didn't even tell the man my full name when I called, and I was simply looking out for his welfare. :rolleyes:

So, how did she find out about you, and what you had said?

Also, please state exactly what she said were her grounds for suing you.

Apparently the gentlemen told her I called, and was worried about getting the money. After all it had been 7 months, and no payment on a brand new car. She didn't state her grounds, she said "I am going to sue you and teach you a lesson for defamation of character." This is a woman who has had 6 lawsuits, for harrasment, dog bites, and backdue rent. She collects SSI and hasn't worked in 14 years. I didn't say she was a crack whore and whatever...I said she has a history of not paying her debts, and I was concerned for him getting paid. He stated he would give her until August because she said she'd get some money then. I said "well if you want to give her the benefit of the doubt, that is fine, but her son called you a jerk. I hardly think that helping her out at this point, being an ex-boyfriend, would be something I would do."

My response:

Sometimes, all you can do is laugh at people like her. She has no case. First, what you said was not defamatory. Second, she has suffered no damages as a result. Third, the information she heard from the man about what you had said is called "hearsay", and hearsay is not admitted as evidence. There's a whole bunch more, but that's enough to keep her from being successful if she decides to sue you.

If she only knew the legal elements necessary for a defamation lawsuit, she might be dangerous. But, as it stands right now, she's just a blow hole.

thanks! That is what I thought. I had finished a business law class last semester and read up a little on it...She claims to have to B.A. degrees...I guess if she did, she would know the law and have a JOB!
 
Oh one more question...IF part of the true statements and opinions I said were at the beginning of the answering machine message, then it still would not matter right?

Truth is an absolute defense and a bar to recovery.

cool!!! I hope she does file now! I'll have every lawsuit case number since she was 20! As well as her arrest info for other unmentionables... :)
