Hi,

Can a person be sued successfully for slander for posting someone's name on a Web site, and making statements that can be considered libelous and false? If so, would damages have to be proven to win the case. Does some law exist regarding slander that damages do not have to be shown? What if the comments have since been deleted, but were seen by other people? What kind of damage awards can be handed down by the courts?
Any help is appreciated.

Yes a person can be sued for posting false information on a web-site. If the material has been deleted, it wont make much difference. The person had no right putting it there to begin with if they knew it was false and damaging. DAMAGES??? that is any ones' guess?? Legal fees and court costs in these cases can be financially draining.

The question was "can a person be sued SUCESSFULLY..." and there is simply not enough information to determine the answer. yes, anyone can be sued for anything. But 'having no right to put it there..." is also wrong. I have a RIGHT to put anything I want on the web, even calling you a drug using hooker. There is no law which abridges that "Right".

As far a 'damages' there does not have to be a showing of harm to award per se damages. But then, since this question is not based on any factual knowledge of the original situaiton, it's not worth answering.

Additional Information:

Former business partners broke up on a very bad note. One of the partners harboring much anger & bitterness, publishes statements stating that the business partner or rather ex-business partner is a "Thief" and engages in "Prostitute Like Behavior" with many partners! Keep in mind it was done out of anger and there is no truth to the allegations!
Is this actionable? It seems the plaintiff attorney is not concerned about proving damages.
As long as they prove the accused posted the statements, and that there is no truth to the allegations whatsoever. They feel this is all they need to do is prove the case and win some settlement. Will a Judge award a settlement simply because it was proven the accused is guilty of posting such defamatory and false statements without damages being proven? Please offer any advice or suggestions..

We don't know what a judge will do. We also don't know why, if the person committed libel, he would be sued for slander. However, ask the paid attorney why he doesn't need to show damages.
