MY FIANCE AND I MET IMMEDIATELY AFTER HE BROKE OFF A 3-YEAR ON/OFF RELATIONSHIP WITH A GIRL WHO WAS HOPING FOR MARRIAGE. BEGINNING IN AUG 99, SHE HAS CALLED HIS MOTHER AND FRIENDS TELLING THEM THAT I AM A "STRIPPER, SLUT, HAVE MORE STDs THAN SHE CAN COUNT". THIS OBVIOUSLY CAUGHT ALOT OF ATTENTION AND CAUSED A LOT OF PROBLEMS, WHICH IS WHAT SHE WANTED I'M SURE. IT'S BEEN 10 MONTHS AND SHE'S STILL RAVING HOW IT ISN'T FAIR THAT HE IS MARRYING ME, NOT HER. CAN I SUE HER FOR SLANDER? IT IS OBVIOUSLY BEING DONE TO INTENTIONALLY INJURE MY REPUTATION AND I HAVE SUFFERED FROM A NUMBER OF STRESS-RELATED SYMPTOMS... LACK OF SLEEP, DEPRESSION, AND EVEN SHINGLES! I FEEL PETTY FOR EVEN CONSIDERING SUING HER, BUT SHE COMES FROM A WEALTHY FAMILY WHO DOES/SAYS WHATEVER THEY WANT TO WHOMEVER THE PLEASE. I DON'T THINK THAT IS FAIR AND WOULD LIKE HER TO BE HELD RESPONSIBLE FOR HER MALICIOUS ACTIONS. WE HAVE NEVER EVEN MET, YET SHE CONTINUES TO TRY TO TURN OTHERS AGAINST ME. I REALIZE HER HEART WAS BROKEN, BUT THAT DOESN'T MEAN SHE CAN RUIN MY LIFE, DOES IT?
I COULD REALLY USE SOME HELP. I'M DEBATING ON TAKING HER TO SMALL CLAIMS COURT FOR SLANDER (LIMIT IS $5,000 BUT THIS IS MORE ABOUT GETTING HER HAND SLAPPED AND TOLD TO STOP THAN IT IS ABOUT MONEY). BESIDES THAT THIS HAS INTERFERED WITH MY LIFE LONG ENOUGH, AND I DON'T WANT A LONG LEGAL BATTLE, I JUST WANT HER TO GO AWAY! DO I HAVE A CASE? WHAT WOULD I NEED TO PROVE? I'D GREATLY APPRECIATE ANYTHING YOU CAN TELL ME. PLEASE HELP!! (I'M FROM WISCONSIN, BY THE WAY)

If they untrue statements of fact that damaging reputation then there might be a claim. A person would then need to prove that untrue statements were made and then bring in evidence as to the damage of the reputation. Generally opinion statements are not actionable; one of the problems with such claims though is that truth is a defense and it may very well put the truthfullness of the statements at the core of the trial, and that can be emotionally hard, to say the least.
