Slanderous comment at large retailer

I had gone to the store to purchase a some computer memory at a national retailer. The memory in this store is in a locked case. I had approached an
employee who was working in the area and had informed him I would like
to purchase the item. My general impression from his attitude at the
time was that I was “bothering” him asking him to retrieve the item for
me. He retrieved the item and proceeded to ring it up. The price the item
came up at was 79.99, but on the peg, it was labeled 69.99 with a $10
rebate. I informed him that the item was tagged at a lower price than
the register rang me up for. Without a word he walked over and removed
the tag from the peg. He then walked off and put a different item in
front of me and stated this is the item we are selling for that price.
It was also a Memory Stick Pro Duo, but in a neon color. I said that is
not the item that I want, and that I wanted the item that was taken out
of the first case, and that I would only pay the tagged price for the
item.
He then got very indignant with me, and began to yell at me saying “I
don’t have to sell you the item for that price!” I had then asked him
to page the manager; he roughly shoved the 2 items and the tag into my
hands and with his voice still elevated “You’ll have to talk to customer
service!”
The two young ladies behind the customer service counter witnessed the
last part.
I had asked them if I could speak to a manager concerning this issue.
And they paged the store for a manager to come up to customer service
for customer assistance. Five minutes went by, and then they re-paged
the manager. One individual wearing a blue shirt walked out from the
office into an isle. I observed the operations manager talking on a
cell phone approximately 20 feet away in the same isle.
The customer service rep said to go over and talk to one of them. I
approached the operations manager, and asked if I could speak to him. I
informed him of the issue I had with the item, and the unprofessional
behavior of the sales floor associate.
He inquired as to who it was, I looked over into the area and there were
2 associates in the area. My response was “The Indian gentleman working
in that area.”
He then replied “Oh, I didn’t know you had a problem with race.”
I am extremely offended that he had labeled me a racist for clarifying
which individual has exhibited the extremely unprofessional behavior. I
then stated, “I don’t have a problem with race, I have a problem with
ignorance.”
I then told him I would have referred to him by name had I known it, but
that there were a variety of employees who work in that department. He
then proceeded to ring up the item, seemingly reluctantly and glaring at
me. He then as an afterthought wrote the employee's name on my reciept.


I had contacted the stores corporate offices, because I felt that being referred to as a racist in front of both other employees and other customers is a signifigant defamation of character. I had spoken with an individual from the corporate office, who then said they would contact the store director. About 40 minutes later I received a call from the store director who asked me multiple times what the operations manager had said to me, as he wanted to quote it verbatim. He then suggested to me that if I needed to buy anything from the store, talk to him or another manager there, and they would help me out monetarily.

I'm not sure if I should just let it drop, and call it a bad shopping experience; take the manager up on his "offer" or if I should pursue legal action.

Any advice would be greatly appriciated.

Let it drop. You'd only lose anyway if you pursued it.

1.) The statement was not slanderous. It was the opinion of the individual who made it. Opinions are protected.

2.) The statement was not broadcast to an audience. So what if someone overheard it? It's unlikely that anyone was paying attention.

3.) You suffered no damages on account of that statement. You may have been offended by it, but that's not damages as the law sees damages.
