I held an "agreement in lieu of mortgage" to be paid to me on sale of her jt/ten house. Former daughter-in-law accused me of forging that document though it was signed and duly notarized. A LOT of accusations were thrown around, I was not present but witnesses will attest. There was no contest from other Jt/tenant. After three hours of hurling accusations toward me, I WAS paid my claim but no one should suffer that sort of blatant slander.
The closing agent (owner of the title company), new buyers of the home and the real estate agents were present along with some other office people. I was made out to be a skunk of the first degree. Former daughter-in-law later recanted pm advice of her attorney and then said she "remembered" the document. She then released the funds to be paid back to me..., several thousand dollars. While I have not suffered any monetary damage, my reputation in this small town has been besmirched to say nothing of my reputation with my new neighbors (the house is next door to mine). This woman KNEW this document would be presented for payment at this closing event...had sufficient advance warning and cussed and swore about what a skunk I was and how dishonest and how I lied, etc.
Please advise validity of a suit. What is the name of your state?
