Illinois; I rent the first floor of a house. My lease ended 2/99. As of date I was never asked to sign another lease, but I have continued to pay 850.00 a month rent since then. My apartment has several repairs (ceiling falling, backed up tub/sink since 8/00, broken windows in every room-since move in date 5/97, etc). I am wanting to not pay rent. My question is this, how long before I actually get put to the curb with no lease. How many months can I occupy the place before I legally have to move? I have spent my own money on little things to make the place more livable. Without a lease, would I just be asked to leave or will go thru the court system. I am aware thru research that with a lease and thru thru the court system it takes approximately 6-8wks before you have to vacate the premise....I would appreciate an acurate length, and yes I am looking for a new place. and yes I have asked for things to be fixed....

Having been there for 4 years, if you are not happy, I do not understand why you don't just give 30 days notice and move.

The landlord can give you 30 days notice and you will have to move. Should you fail to vacate within the 30 days, you would be evicted and ordered to pay all back rent and damages for not leaving on time. In fact, under circumstances that you describe, it would be considered to be an eviction with malice, and you could be ordered to pay treble damages.

Go ahead dont pay the rent, you would deserve the consequences...little girl.

an eviction a judgement on your credit report no reference from this landlord...

oooooh the feeling of sticking it to a slumlord!!!

I would try to contact Legal Aid Society. I know that there is such a thing as a process of if you can not get repairs done on the property that you rent, you do have to prove that you tried to let the landlord know that the repairs were in need, and he /she repeatedly did nothing to fix them. Then you set up a account that you deposit your rent into, in other words you still have to pay rent just you don't pay it to the landlord. I do know that there is such a thing, but proper proceedure I am not sure of contact legal aid I know they have the form, and lots of info.
