In the Small Claims Handbook, supplied by the court, it states, "if the defendent wishes to file a counter claim they need to do so 5 days after receipt of original notice."
It also has a stipulation that the judge makes the final determination.
I am going against a company in which after the first appearance before the judge filed this counter claim. I think this is partly to try to scare me to drop the case against them, however, can I make a motion to have this dismissed? Should I make a motion to have this dismissed?What is the best way to do so? Does a judge favor a person when faces a corporation and their lawyer? Any advice would be helpful.
