I recently sued in CA small claims court for a automatic pool cover that didn't last within its warranty. The cover first degraded during the first year and was replace. The second cover degraded again within a year and the company refused to replace the cover. The company stated that there is something in my backyard that is causing the cover to degrade. I responded that there is nothing unusual with my landscaping and my poolwater is always in balance. Also, I have had two previous pool covers from different companies that lasted 7 years each. I filed for suit in small claims court, but before going to court the company agreed (under duress)to replace my cover. I therefore dismissed the suit. My question is did my suit have merit and what should I do if there is something inferior with this company's cover and it happens again? thanks in advance.
