I won a judgement in small claims because the defendent did not appear in court. My judjement does not indicate with or without predjudice. The defendent has appealed the decision and reopened the case in district court. Is the appeal only against the judgement, or can he now claim legal fees etc. against me? Is there a difference between an appeal and a counterclaim?

This is my nonlegal general state advice:

For the Judgment only. No lawyers fee, I assume that there is no lawyers involved (small claims, you usually can do on your own w/o atty)

An appeal means that a decision was rendered and he/she doesn't agree and therefore appeals.

A counterclaim is a claim made against you from the defendant during the time the judgment is in court, not after judgment is rendered.

Sorry I can't be of more help, but it looks like you are on a time restaint of this info.

Best to check with the court clerk and see if they can point you in the right direction for your complete info.
