My daughter is being sued in small claims court in SC for $1500 by her former landlord for back rent and damage to garage apartment. Is a signed unit condition report required in SC? They didn't have one. Can salary be garnished in SC for a small claims judgment? Does the court set a payment schedule for her if the judgment is against her and she doesn't have it all to pay at once? If the only asset she has in her name is a $900 car and that enables her to get to work, can that be taken from her? She paid her rent in cash--did not get receipts, lived there one year, got on well with landlord, except landlord didn't fix refrig. (didn't work for 6 mon. and toilet had to be flushed by hand); landlord also used my daughter's phone when her's was turned off for lack of payment. My daughter came home from work on 3 occasions to find she had no electric because landlord had failed to pay electric bill. My daughter did not sign a lease. She was suprized to get the subpoena after she moved out because she had told the landlord she had to move in with friends for a while because she could not pay rent anymore having lost her job till she got a new one. The subpoena was delivered 10 days after she left. A hard lesson, but with the exception of candle wax on the very old and fraying carpet of this one room garage apt. she did no damage to it. I was there many times as were many of her friends--should she take statements or friends to court? Thank you!
