small claims? etc

my wife and i have done business on ebay for the last 2 years without any problem. had this guy, big time auction dealer with sportscards (great feedback, etc) sell us some big ticket cards and the cards never arrived, although he took possession of payment electronically via paypal. keeps giving us sob stories and hasn't sent the goods or returned the payment.

he has since been banned from ebay and his accounts closed with paypal. any suggestions on a course of action. i want to go to small claims court, but filing a police report isn't out of the realm either. would appreciate any assistance on this issue.
