I purchased online a product for $600.00. I used Paypal which is an online credit card company. This person was a registered paypal user and verified and a large ebay seller. This person refuses to send me the product, refund my money and will not respond to phone calls or emails. I am in NC and he is in Virginia. IfI take him to small claims court would I file in NC or Virginia ?

Before you consider any legal action, have you contacted PayPal. They do have a protection policy. Details can be found at:http://www.paypal.com/cgi-bin/webscr?cmd=_help-ext&eloc=184&loc=181

Also, ebay has an insurance policy, have you contacted them??

Also, if your purchase was made using your credit card to PayPal, you can also dispute the charge on your credit account (See the Fair Credit Billing Act at http://www/ftc.gov/ ).

If all else fails, then you would have to file in the state where the Defendant has assets. This is so that you will have assets to seize in the event of his failure to pay the judgment.
