Hello,

I lost a small claims case last year for $5400. At this point i have repaid $4600 with interest. Apparently the plaintiff does not like the pace at which i am making payments and continues to contact me for "Final" payment. My questions is:

Is there a minimum amount that needs to be paid?
Is there a maximum time between payments?

Under the order by the judge it does not specify anything except there is a 4.5 % APR per year on the remaining balance.

Unless the court imposed a repayment schedule a money judgment is nothing more that a piece of
Paper that says you officially owe the judgment creditor money. If you do not make payments willingly the judgment creditor can take the same actions available to any other creditor. That means they can levy bank accounts, garnish wages, seize property, or anything else the law may allow.

No to both questions.

But you pay as much as you can as fast as you can and hope it's enough to keep the judgment creditor from garnishing your pay or levying your bank account.

I have one suggestion.

When you are ready to make the final payment, do it in person and get him to sign a satisfaction of judgment.

You'll find some Florida samples on the internet or your local court might have its own form.

Is this the chap who wrote something .. perhaps .. less-than-nice ... on one of the checks he sent?
