Hello,
I got sued in small claims court for an apartment lease that was broke. My Exgirlfriend and I signed the contract and we were both sued .....the amount was 3000+ court costs in Morgan County Indiana. I live in Ohio now and she lives somewhere in Nevada.
I have been paying 75.00 a month for the last 5 months. I have to show up every month to pay the amount in court . Even the land lord has to show up !!!! My exgirlfriend has never shown up and the court is going to issue a body atachment warrent for 2000 dollars if she doesn't show up again ...I have not heard from her in months. My question is if she never pays for anything will I be responisible for the entire 3000.00+ court costs? I have been saveing and I hope to pay $1150.00 next time I goto court on the 10th of October this is half of the total with all the court costs. help anyone ????

What does the judgment say??
Most of the time, when you have two parties responsible for the debt, the creditor can collect the full amount from any or all parties (severability). There is NO requirement for equalization of the payments.

Bottom line... if you are the only one making payment, you have to pay all of it. Then, if you want, you can sue the other party for their payments that you made.
