small claims or torte? labor board or not?

My daughter who is 15 years old was working for a man who pleaded down to charges of nuisance of a minor. My daughter still suffers from anxiety and depression due to this incident which occurred almost a year ago, and will not work. She was saving for a car, and I would like to take this man to court to ask for damages because of this. Is this a small claims issue or a torte? He did not have 15 people working at one time so it is my understanding that i cannot go through EEOC or NERC. Secondly, she has not received a W-2 for 1999. I have called and requested it and have been ignored. My daughter told me that she was getting a personal check which I was unaware of so I am suspicious of him "paying her under the table". He also did not pay her for her last week of employment. Who should I contact to report this so that she can get her last paycheck, and assure that she has complied with tax law? Please help
