I'm not sure if this is the right forum..but here goes. I own a mobile home in a park. The park rent is $280/month and they are responsible for plowing the roads. They do a horrible job of this! We have several inches of ice in some spots making driving awful. Now it has caused damage to my car. My question is whether or not the park is liable for the damages. Thank you for any help!

It all depends on the damage to the car, your money damages, and whether you have EVIDENCE to show that the trailer parks negligence (in plowing the roads) was a direct cause of your damage. If you just have a 'hunch' that their lack of plowing caused the damage, it isn't sufficient.

Also, have you previously formalized your complaints (in writing)???? If not, just your word against theirs.

Thanks for your reply. We have pictures of the roads in the park and even took pictures of roads outside the park to compare. Several of the residents of the park have written to the real estate company that owns the park and they do not respond. The auto place said the damage happened by something scraping the underneath my car and found ice jammed underneath the car. We had the same problems last year too. It's getting expensive to keep repairing our vehicles every winter because of their negligence. We pay pretty high lot rent..they can most definitely afford salt! :)

Okay, sounds like you have your 'ducks in a row'.

Now, you need to consider whether it is worth the time and cost to pursue recovery from the owner.

1) Check you local library or bookstore. Look for books on Small Claims court how-to's.
2) Contact your local Small Claims court. Ask them for a 'complaint package'. It should include forms and instructions on how to file an action.

Then, go for it.
