Two months ago I purchased a 1999 truck for my son from an individual who was stationed locally in the Hampton Roads area of Virginia. The seller sent me an email outlining the items he was including in the sale for the offering price. I agreed and paid that price. One of the items was a factory extended warranty contract, which was transferable from the first owner to a second. This was a major consideration and the seller assured me that he had maintained the contract. He said he would provide the required records after he got to his new duty station overseas. He did not provide the required proof of servicing the truck as indicated by the Toyota and therefore they will not let the warranty be transferred to me. I had to purchase, at $1200, a separate policy thru another organization to insure coverage for my son who is away at college. The seller indicated that he had performed some of the required servicing himself and had receipts for proof. He did not. Do I have a claim within the small claims range and how should I proceed since he is overseas?
