I was engaged to be married. I lent $2,000 to him. I also gave him $1,500 toward a down payment on his truck. He has run his cell phone bill up over $800 and not given me any money. He took $300 out of my account using an ATM card after we broke it off (stole it) Do I have a leg to stand on if nothing is in writing. He told me he would pay me back. The cell phone is in my name but it was his and only he used it. I have a cancelled check for the down payment on the truck. Nothing but his so called word that he would pay me back the $2,000 and take care of his cell phone bill. Can I take him to small claim court to get my money back and do I have a chance at getting it?

Geez....you are right out of a Judge Judy episode!!

Don't expect a court to solve your love problems. When you share assets without the benefit of marriage, you do so at your own risk.

However, depending on how you present yourself, you could possibly recover something, especially the ATM withdrawal and the cell phone bill (can you prove HE did it??)

Have ALL (can I stress this enough!!!) ALL ALL ALL bank and phone records you can that support your cause...but be truthful in what were actually gifts of the heart, and what were loans.

Watch Judge Judy anyday of the week...pay attention to HER questions and rulings (not the emotions of the parties), and you'll have a good idea of your chances.
