Vermont State
Well, my landlord and I are both at our wits end I believe. My neighbors from hell in our duplex were served a while ago by the sheriff and their "leave date" is 06/30 which is fast approaching. And for a laugh... they were on the porch smoking when they got served by the sheriff *rolls eyes*
Our home is sweltering because we have all the windows closed to try and keep as much of the cigarette smoke out of our house but it isn't working... the house is older.
They are throwing more garbage all over the place and obviously have no intentions of leaving. My landlord called me today to inform me that she will be contacting her lawyer tomorrow to begin work on the papers for the court order to get them out in five days by sheriff after the 30th. I also provided my landlord with official paperwork from my daughters physician describing her reactive airway disease and my physician describing the the physical damge from the assault by this next door neighbor.
They are not paying the landlord rent, and are claiming it is in a private account. I have been doing some reading and it seems that the only way they can withold the rent in this "dispute" would be by a judges order to place the money in escrow with the court clerk.
As for the assault, her court date has come and gone. She did not have to enter a plea either way, the judge offered her the possibility of a Restorative Justice program here in Vermont. Apparently if she is accepted into this program she has to admit fault, and take responisibility for her actions, which should include restitution for damages incurred for my family via a contract, which if she does not accept the terms of the contract by this board, or is not accepted by the board initially, she will then be bounced back to court for criminal proceedings.
Is it in my best interest to wait to see the outcome of this restorative justice program? or do I sue her now?
I have been putting together notes of everything that I can remember that has been going on and or happened since these "Winners" moved in next door. I do not speak/ look at them when we leave or come home, even when they make it difficult...
I have made well over a dozen phone calls to the DA'S office to contact the victims advocate, however I always get transferred to voicemail. I have a feeling she is severely overworked...
I have also tried contacting the health department regarding the smoking at least until they are evicted... however I am not receiving a response from them either....
Is there anything else that I can do and that my landlord can do to make this go as smoothly as possible?
