What is the name of your state (only U.S. law)? Kansas
Can anyone tell me if issuing an administrative law citation is the same as a local ordinance violation and if it is less stringent than a misdemeanor? This is a new ordinance the city of Topeka has come up with and the state statute says that the local municipalities can only write laws that are more stringent than the states statute pertaining to the same statute. Well the state statute a smoking violation is a misdemeanor charge, and it was the same with the old ordinance that the city had. Now they have come up with this new ordinance and new administrative adjudication process, issuing administrative law citations for violating the smoking ordinance.What is the name of your state (only U.S. law)?
