snd party garnished checking account

State Florida, My checking account has been frozen or garnished because my husband has a debt that he owed years before I meet or married him. he is listed on my checking account because I added when we got married. should i be punished for his old debt.

Just how old is this debt ?? It may be out of statute, which means the statute of limitations has run out. In FL, the SOL is 4 or 5 years, depending on the type. If the SOL has run you, you might be able to contest the whole thing based on the SOL.

As for whether or not you can be held responsible, well, the bank doesn't care much, all they know is that HIS name is on an account with money in it, so they're going to take what's in it to pay the debt.
