What is the name of your state? Georgia
My understanding of the Georgia SS Disability law for attorney fees are on a contingent basis of 25% up to a $5300 maximum. Doesn't this give an incentive to make the process drag on long enough for an attorney to get the maximum amount? If your disability amount was $1000 per month and it took 12 months past the 5 month waiting period to get a decision from SSA the attorney fee would be $3000. It would be in the attorneys monitory interest to make this case go on for at least 22 months past the 5 month waiting period for them to receive the maximum amount. Some one please tell me I'm wrong and show me why?

There is a 5 month waiting period of eligibility after your disability onset date , as I understand it .

The actual process of being determined eligible could take months , especially if you're denied in the first process .

Then there would be reconsideration , then appeals .

It's not the attorney dragging his/her/their feet .

It's the process .

And for the most part, SS attorneys are paid from the settlement/retroactive payment check. If/When you get your check, you need to call the attorney and make sure the SSA paid them from those benefits; otherwise, the attorney will come after you. (BTDT)

from my understanding the attorney gets either 25% or 5300 which ever is lowest..i could be wrong but i am pretty sure that is what the judge said to me.. and also i hired mine last October and he did not drag it out..went to court in Jan and case settled.
