I was recently told that from 8/02 through 8/04 that I wasn't eligible for SSD,
but during that time they continued review my claim, find me still eligible, and
sent me checks monthly. Apparently someone miscalculated my trial work
period months and it turns out I wasn't eligible under that claim during that
time. Had someone told me, I could have just filed a new claim and everything
would have been fine. But now they say I owe them over $12,000. I filed a
form to waive the $12,000. What should I do now. Should I also file for a
reconsideration? Should I see a lawyer?
Second problem, on 8/20/04 I filed a new claim for SSD. It was supposed to
be an expidited claim and they said that I would received payments for the
first six months while my claim was reviewed and that if I was not found
eligible that I would have to pay back that money. It has been almost three
months now and I haven't received a cent. My case worker does not
return my phone calls (I don't know how many times I have tried, but it has
been a lot). His supervisor does not return my calls. I tried to call the
local office and no one answers. The national 800# has no information for
me. What do I do? Can I sue the case worker? I went into the office about
three of weeks ago and they talked to the case worker and he said that
he would file the paperwork to start my checks then. I haven't heard a thing
and shouldn't he have filed that paperwork back in August?
