My business granted a non exclusive software license to another business for no charge. Next thing I know, the licensee's website has a bold statement on the bottom of the page thanking our business for our "donation" of a software license. I kindly asked them to remove the word "donation" because it denotes a relinquishment of our rights as a licensor. Their attorney responded and said the actual words on the website are "donation of a LICENSE". Therefore, they are not implying that they own all rights to the software but are merely acknowleding our donation of this license and their status as a licensee. They are refusing to remove the word donation until they see a legal reason to do so. My question is this: Even though the website makes it clear that they are a licensee, I want the word "donation" removed for my own reasons. I want to assign my rights as a licensor or possibly sell this software outright and I feel that the word donation hurts my efforts in that it gives others the impression that I have given something more than I actually have to this other business. Even if this reason may sound silly, the bottom line is that I granted a license for $0.00. There was no donation of any kind. Is there any valid legal reason that I can bring forth to their attorney so that they will take this word off of their website? Any help would be greatly appreciated.
