SOL in Texas

What is the name of your state? Texas

What is the SOL in Texas for credit card debt? If I have some old debt that I cannot pay, how should I proceed?

Can a credit card company sell the debt to a new owner, and then that owner put a new entry on my credit report while leaving the old owner on the report? Plus, the sold account is reporting the date as much later than the last date I made a payment - so as to make the debt look much more recent.

How would I go about fighting such a thing? How long can a CRA report debts? The last date of action on this debt was 2001. But they are reporting it as sold to someone else and re-aged the account (with a brand new entry in the CRA's as 2003)

Also, people call me and tell me that they can garnish my wages to get it back and make threats. I tell them in Texas they cannot garnish wages so then they tell me they will sue. (IIRC, they cannot threaten to sue, unless they really intend on suing).

First of all SOL in Texas for all debts is 4 years from date of last activity. You are correct that the CA CANNOT garnish your wages. They also can't put the same debt on your CR twice and reage it. You are also correct that they cannot threaten to sue unless they intend on following through.

That CA is violating so many laws of the FDCPA that once you get through with them they will owe more for the violations then you owe for the debt. Report each and every violation. Below is a link that has info about the FDCPA.
