What is the name of your state? Indiana

Can someone tell me the SOL on credit card debt in Indiana? My wages were also garnished, will this start the SOL over again?

Also, I signed as responsible party for some medical bills for my mother. These were also turned over to collections. Is there a SOL on this too?

Am I right in assuming that

A. even tho the SOL is up the creditors can still harass me forever? (they have a civil judgement against me)

B. The SOL being up will allow me to get credit again?

The Indiana SOL for credit card (open accounts) is six years.

No. In order to garnish your wages for a debt, the creditor must have obtained a judgment. As such, the SOL in IN for a judgment is 20 years.

Yes. The IN SOL for a written contract is 10 years.

Yes. but they can only enforce the debt or judgment for the SOL period noted above.

B. The SOL being up will allow me to get credit again?
*** You can get credit anytime you want and can find a creditor willing to open an account for you. This has nothing to do with the SOL expiration on another debt or judgment.

So, let me see if I have this right. Because there was a judgement against me (and you are right, there was) the creditors can still come after me for both the credit card debt and the medical bills for 20 years after the judgement date? Or for the 6 years/10 years of the original debt? I can't even open a bank account, the last time I did they seized the money in the account!

Each creditor/collector would carry there own judgement. So from the way it sounds you are talking about two separate judgements. One for the credit card, and one for the medical. Each one carries a maximum of 20 years from the date of issuance from the courts. The awarded party can then request to the courts to place liens on certain property go after your bank account. (as you attested to..), or garnish wages. You also have the opportunity that if your finances do improve to work out a satisfying of judgement, where by they would remove the judgement based on your paying the debt in full. All this should be in writing as the courts will need verification that the judgement was satisfied.

Though correct, your post is meaningless since the OP has confirmed that these are JUDGMENTS and no longer simply 'open accounts'.
