In Florida: Who has the burden of proof of SOL? Does the CA have to prove I am still within it, or do I have to prove I've past it? This is my situation. Is Experian, and such, the legal proof used in court?:confused:

My response:

It's your burden.

Once a Plaintiff has proved a prima facia case, regardless of your defenses, then the burden shifts to you to show, and prove, your defenses. If you don't plead the SOL as your defense, then no matter what the dates might be, you could be held liable.
