I sold a home (in 2007) due to a divorce & it was totally my gain or loss. At the time it was my main home. It ended up getting a loss on the sale. The mortgage company is looking to me for the $ 30k shortage..... and that is another subject.

However, I got married in late 2007. Now that we are filing our tax return, how can this loss be a deductible item for our joint return? Or do I have to file separately? Everything I'm seeing states that if it's my main home it's not deductible?

Help!!! & thanks!

The only one that I know are catastrophic casualty losses which, traumatic as they are, divorces don't qualify.

The mortgage company has foreclosed this matter on me. Is there anything that can be done "tax wise" for the foreclosure or loss?

I am going to add one proviso, just in case the OP isn't telling the whole story. If he/she gets a 1099A or C for the remainder of the mortgage, it may not be taxable income. He/she should consult a tax professional regarding that. However that is the only tax related issue regarding the home.
