I sold a 1983 Camaro to an individual for $2k, as is, no implied warranty of any kind written or spoken (no bill of sale was written/signed, only title transfer papers). We filled out all the paper work for title transfer into thier name on site (my house) including filling out and signing of the title itself. When they got the vehicle to their residence, about 50 miles away and on the same day, they discovered there was frame rust, causing some mechanical problems (they said the transmission cross member fell off, causing the transmission to almost fall completely out). I have only had the car about 8 months myself and had no idea it had bad rust issues. They test drove the vehicle before purchasing and claimed to be happy with it. They now want a full refund of their money and want to return the broken vehicle to me. Am I obligated under any law to give a full refund and accept the broken vehicle I sold them in return?
Again, I am not trying to be immoral....and did offer to pay them $200 from what they paid me to assist in repairs. I feel bad for them and have been losing sleep the past couple nights because I am afraid of what legal action they could take against me because of this whole issue. I sold them the car two days ago and they said it broke just a couple hours of driving it out of my driveway. Do they have a legal leg to stand on against me? Should I worry, or just tell them "Oh well".
