We bought a car for my son 6 mos ago. The check engine light was on. They said they fixed it, smogged it and the code just wouldn't clear. It needs an air flow sensor.
We sold it 2 days ago. I did not know that I needed to smog it first. The buyer didn't know that either. They took it into a shop and were told that lots of codes came up which could be a computer issue or as bad as needing a new transmission. The check engine light could be an electrical short.
When they bought it I told them about the known issues and that I do not personally drive it, nor have I taken it into a shop. I told them it needed some repairs, reduced the car price to cover it and wrote the words "sold as is" onto the bill of sale and had her initial those words and sign the paper.
They want their money back or they say they will sue. She didn't mention the smog issue to me, just the possible transmission repairs. In looking through this site, I've just found out that I need to smog it myself, but it's buyer beware regarding any further repairs. Do I have that right or am I way off base?
Can I smog it at the shop it's at and pay for this process including any repairs needed for the smog when the car has already had the title signed over to them? How can I authorize this if it's not my car?
I feel very upset about this. I hate to think that they got a bad deal. I do not want the car back, and do not have the money for extensive repairs. I'm told the buyer is responsible for checking it out prior to the sale and if they do not they are accepting it the way it is. I told them to have it checked out before they bought it. They took a test drive, and he didn't notice any problems at all. They chose not to have it checked out and bought it immediately.
What are my legal responsibilities. I do not want to get sued. I also do not want the car back. How do I handle the smog issue? Please help. They want their money back immediately.
