We sold custom printed materials to a buyer in New Jersey. They received the items and stated that the colors were not what they expected and that they colors did not match what they saw online. The contract they signed, as well as the policies page of our website, states that colors seen online may not exactly match the final printed product due to differences in monitor settings. This isn't a case of someone seeing something that looked purple and the final item being green; it's a matter of the shade of the printed color.
The buyer asked for a full refund; however, contract and website states that we can not give refunds due to the custom nature of the product. We did offer to try and reprint the product for them, but they refused the reprint. They are now threatening to take us to court under the NJ Consumer Fraud Act 56:8-1 if we don't issue them a refund.
My question is: what are our options in this matter? If we don't refund, will we be forced to go to court in New Jersey? Does the N.J.S.A. 56:8-1 apply to custom goods?
