I live in Pa and agreed to sell my mobile home to friends, the only contract that I have with them is hand written, and simply states the purchase price, payment amount and date, what their responsabilites are (taxes, utilites, ect.). The contract also states that should they become more than 60 days behind that that forfit any and all money invested, and the home will be returned to me. Here is my problem ... When they purchased the home they did not have the money for the downpayment, I agreed to let them pay it on May 1, 2001 ... (this is written in the contract). It is now almost the 1st of September and they still have not paid it. I have hand delivered 30 day delinquent notices as I was instructed to do by my local magistrate, but still have not recieved the payment. At this point I do not want the payment, and would much rather have the home back. The magistrate that I spoke with informed me that this is not a landlord/tennent dispute and could not be handled in his court due to the fact that there is a purchase agreement. As a single parent I can not afford an attorney right now. Here is the question ... what do I have to do to get them out? If I have to go through a court will I need an attorney to file the papers or can I do it myself? I appreciate any advice you can give me. Thanks!!
