What is the name of your state? OH

I was selling my Motorcycle 'as-is', I disclosed all problems with the bike (including the transmission problem). He test drove it, inspected it, then took posession and purchased it from me.

Only problem is I didn't have the title notarized before hand, I signed it over, he took the bike with him...he told me his uncle was a notary not to worry, he would get it notarized. I originally told him I would get it notarized and send the title to him, he refused.

Now, he's decided he doesnt want the bike anymore, he never got the title notarized and he sent me a letter from his Attorney threatening to give the bike back and they want the money back. This can't be possible? Does he have a case?

You do not have to have the title notorized. If you signed it as the seller and put him down as the buyer then he now owns the bike. it was up to him to get title transferred to him so he could get tags.

Did you write up a bill of sale for it?

No bill of sale, I signed the title and filled out all my pertinent information. I did fill out the odometer readings and signed in all the Seller locations.
It was a cash transaction. He took possession of the bike and took the title with him. His explanation was that he would fill out the information later and that his uncle was a notary, so it was no problem.

Title...
I do not believe that he filled out any of his title information as him being the buyer. (ie. his name, address, etc..)

Assuming he didn't sign the title and if he didn't fill out any of the information, the bike is still mine correct? Basically he has a bike with a title in my name, no receipt that any kind of transaction has taken place.

Should I be concerned there was no official sale, since he didn't fill in the title information?

(which doesn't make since to me)

I'm guessing the bike is now totaled

and he's trying to screw you

call the attorney general in your state to see what the laws are for private sales of a motor vehicle

Transferring the title is not required in order to sell a vehicle (although it is something the new owner must do). Since you have the money, and he has the bike, it sounds like the contract has already been completed. I don't think he has a case, unless there are facts you aren't telling us (e.g. fraud, etc).
