sold my car

I am from Verndale MN. And about a year and a half ago I sold my 83 Mustang GT for the price of $4500. We have a written and signed agreement for the sale and purchase of the car, but the agreement lacked a payoff date. To this day I have recieved only $800. I am wondering what to do about this. The buyer gave me his phone number that has been disconnected for along time. I have an address that he no longer lives at. And I want to get the car payed off. Another important note is that I do hold the title and have the car in my possesion.

Did you say that you have the title AND the vehicle?? If so, this is pretty simple.... you don't get anymore money!! By taking the vehicle back and never transferring the title, you have accepted rescinsion of any sales agreement that you might have had.

I would send the 'buyer' a certified letter (RRR) giving him a specific time (14 days from receipt??) for him to contact you to complete the sale. Include notice that if he fails to contact you, he forfeits any claims to moneys paid as compensation for your losses, etc.

Yes I do have the car and the title. A friend of mine had also told me to write a similar letter.The only problem I have is that the address that he gave me on the purchase agreement is no longer where he lives. I know this because the address he gave me is to where he lived at the time, but at the same time he was putting the house up for sale. Then shortly after that he moved a little closer to where i live. Which was great, But then it turns out he moved and now I have no idea where he is at. So do I just send the letter to the address on the agreement and hope it gets there?

Well it seems to me if you have the car AND the title, AND this person has moved and you no longer know where they reside AND they haven't bothered to let you know....it sounds to me like this person is telling you to keep the $800 AND keep the car.

I would just re-sell the car. Worse comes to worse the guy might show up and ask for his $800 back. In which case you might or might not be legally required to give it back.

Send the letter to his last known address. Keep copies of all documents. Send it Certified RRR.

What is a certified RRR letter and how or where do I get one?

Another important note is that last month he did call me to talk to and he did leave me his phone number which was great, but I tried calling it and the first time he was not ther but I did talk to someone. The next time and every time after that up until now the number Is disconnected. What do I do now?

Certified RRR is a letter sent certified mail, with a return receipt requested. Just a way to show you did everything possible to contact the person and provide evidence that your letter was received.

Here's a novel idea- why don't you take the money he has paid so far, and open a bank savings account. That way, you won't be accused of taking his money and running, can sell the car to someone else, and will have the cash to return to him if you have to (and why wouldn't you just want to?). Worst case scenario, you earn a few pennies from the interest.
