I sold a house to somebody out of state, and he wasn't here for closing or final inspection, here in minnesota also we prorated rent, then we put to our understanding, the deposit money from the renters into an escrow acct. being held by the title co. the tenants have moved out and I told them he has the money so therefore he would be returning the deposit. The new owner then sent the tenant back to us saying that we have to return their deposit, and that the money put into the escrow acct. was his security from us personally since he could not be there to do a final walk thru inspection. Who is now responsible for returning the deposit money to the former tenant? Are we liable for anything?
