I have two children involved in a custody situation. One the NCS adopted. He has chosen to not take visitation of the child he adopted nor does he want much to do with her. I would like to ask for sole custody of the daughter whom he adopted (she is my biological daughter) and joint for the child we had together. His lawyer says it wont happen...any thoughts?
Are you saying that this father comes and picks up the child you had together and leaves the adopted daughter behind? What a skunk!! And his lawyer says you won't get custody of the adopted daughter, or you won't get joint custody of the other child?
I hope you have your own lawyer. You need to stop listening to HIS lawyer. Joint custody is pretty much standard any more, so unless you've got a history as a "bad mother" I don't know why you wouldn't get the joint custody. (Make sure you don't interfere with his visitation!) As far as sole custody of the other daughter, I would really press the issue of him not taking visitation with her. That has to be hurtful to that poor child.
Good Luck!
